Terms and Conditions for Tree Surgery Services
These Terms and Conditions set out the basis on which Tree Surgeons Euston provides domestic and commercial arboricultural services. By requesting a quotation, accepting a proposal, making a booking, or allowing work to commence, the client agrees to be bound by these terms. For the avoidance of doubt, these terms apply to all tree surgery, tree maintenance, pruning, felling, crown work, stump-related services, and associated waste removal unless a separate written agreement states otherwise.
In these terms, references to “we”, “us”, and “our” mean the service provider operating under the name Tree Surgeons Euston. References to “you” and “your” mean the customer, property owner, occupier, or authorised representative requesting the work. These conditions are intended to provide clarity, manage expectations, and ensure that tree surgery services are delivered safely, lawfully, and professionally.
These terms should be read alongside any written quotation, work schedule, or invoice issued in relation to a specific job. If any part of a quotation conflicts with these terms, the wording in the written quotation will take precedence only for that job and only to the extent of the inconsistency. All other terms remain in full force and effect.
The booking process begins when you make an enquiry and provide the information reasonably required to assess the work. This may include the type and number of trees, access conditions, the condition of the site, any known hazards, and whether permissions or third-party consents may be needed. Any quotation we provide is usually based on the information supplied at the time of enquiry and, where appropriate, a site visit or remote assessment. If the information later proves to be incomplete or inaccurate, the scope, price, and timing of the works may need to be revised.
A booking is not confirmed until we have accepted the work and, where relevant, received any required deposit or written confirmation from you. We reserve the right to decline a booking, amend the proposed date, or withdraw a quotation if access, safety, legal, or practical issues arise. In the case of a tree surgery service requiring specialist machinery, traffic management, or additional operatives, a booking may also depend on weather conditions, ground conditions, and local restrictions that affect safe delivery of the works.
You are responsible for ensuring that we can gain safe and timely access to the property and work area on the agreed date. This includes arranging keys, unlocking gates, moving vehicles, securing pets, and advising us of any hidden services, fragile structures, or protected features that may affect the works. If access is delayed or impossible because of matters within your control, we may charge reasonable waiting time, abortive attendance costs, or a rescheduling fee.
All prices are quoted in pounds sterling unless stated otherwise. Quotations may be either fixed-price or estimated. A fixed-price quotation covers the work described in the quotation and no more. An estimate is a provisional price and may change if the actual work, time, access, timber volume, or disposal requirements differ from the original assumptions. If additional work becomes necessary, we will normally seek your approval before proceeding where this is reasonably practicable.
Payments must be made in accordance with the terms stated on the invoice or quotation. Unless agreed otherwise in writing, payment is due upon completion of the work and prior to removal of tools, machinery, or waste from the site. We may require a deposit for larger jobs, repeat visits, or work requiring advance ordering of materials or specialist equipment. Deposits are generally used to secure the booking and are non-refundable where work has been scheduled and resources allocated, except where required by law or where we cancel the booking without reasonable cause.
Where payment is not received by the due date, we reserve the right to charge interest and recovery costs in line with the late payment provisions applicable under UK law, where relevant. We may also suspend further work, retain title to any materials supplied until paid for in full, and decline to accept additional instructions until arrears are cleared. Any bank charges, chargeback fees, or payment processing reversals caused by your payment provider may be passed on to you where permitted.
Cancellations and rescheduling requests should be made as soon as possible. If you cancel a booking after we have allocated staff, plant, or specialist subcontractors, we may charge reasonable cancellation costs to reflect expenses already incurred and lost business opportunity. The closer the cancellation is to the planned date, the more likely it is that substantial costs will apply, especially where access equipment, traffic controls, or waste arrangements have already been organised. If we cancel because of severe weather, unsafe site conditions, or circumstances beyond our control, we will endeavour to rearrange the work on a mutually convenient date.
We may also cancel or postpone a booking where continuing with the work would be unsafe, unlawful, or impractical. This includes situations involving high winds, lightning, ice, inadequate access, unstable trees, disputed ownership, objections from relevant authorities, or the discovery of unexpected hazards such as asbestos, hidden cables, or structural defects. In such cases, any payment already made will be treated in accordance with the terms of the quotation and the reason for cancellation, including any lawful deduction for work already completed or costs incurred.
Our obligations are to carry out tree surgery with reasonable skill and care, using appropriately trained personnel and suitable equipment. However, tree work is inherently risky and outcomes can be affected by unpredictable factors, including hidden decay, storm damage, soil instability, pest activity, and the response of a living tree to pruning or reduction. We do not guarantee that a tree will survive after surgery, that regrowth will not occur, or that future issues will be entirely prevented, unless such a guarantee is expressly stated in writing as part of the service.
To the fullest extent permitted by law, we shall not be liable for any loss or damage arising from circumstances outside our reasonable control, including acts of nature, adverse weather, third-party interference, or information supplied by you that is incomplete or inaccurate. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law. Where liability is established, our responsibility will be limited to the direct loss or damage reasonably foreseeable at the time the contract was formed.
We are not responsible for pre-existing defects, hidden damage, or weaknesses in trees, fences, paving, buildings, or underground services that were not reasonably visible before work began. If you ask us to proceed despite a warning about a known risk, you accept the consequences of that decision to the extent permitted by law. Any advice we provide is given in good faith based on the information available at the time, but it should not be treated as a guarantee unless confirmed in writing.
The client is responsible for obtaining any consents, permissions, or approvals required before the work begins, including permission from landlords, neighbours, management companies, local authorities, or relevant conservation or preservation bodies where applicable. Where a tree is subject to legal protection or there are restrictions affecting the site, you must tell us before the appointment. If work is delayed or prevented because the necessary permission has not been obtained, any resulting costs may be charged to you.
Waste produced during tree surgery may include branches, timber, brushwood, leaves, stump arisings, and other green waste. Unless otherwise agreed, we will remove and dispose of waste in a lawful manner and in accordance with applicable environmental and waste management regulations. Waste transfer will be arranged through compliant channels, and material will be processed, recycled, reused, or disposed of where appropriate. We may retain firewood, timber, chips, or other by-products only if this has been agreed in advance in writing or is reflected in the quotation.
You must not request or expect us to dispose of waste unlawfully, and we will not transport or leave materials in a way that breaches environmental, planning, highway, or nuisance regulations. If you instruct us to leave waste on site, you are responsible for its storage, containment, and subsequent lawful disposal. Should you request additional waste removal beyond the agreed scope, this may result in extra charges based on volume, labour, transport, and disposal fees. We reserve the right to refuse removal of contaminated or hazardous waste if it falls outside our service scope or legal authority.
Any stump treatment, stump grinding, or related works may leave residual material, ground disturbance, or settling of soil, and these consequences are not defects if they are inherent to the method chosen. You are responsible for informing us of buried services, drainage runs, irrigation systems, or other below-ground features before work begins. If waste regulations or site conditions require special handling, you agree that additional time or costs may be necessary to complete the work safely and lawfully.
All personnel working on our behalf are expected to follow appropriate health and safety practices. You must not interfere with machinery, climb equipment, or enter the work zone without permission. Children, visitors, and pets should be kept away from the area while work is in progress. If unsafe behaviour from occupants, visitors, or third parties prevents us from working safely, we may suspend the job, charge for time lost, or leave the site until conditions improve.
Any dates or times given are estimates unless expressly stated as fixed appointments. Tree surgery appointments may be affected by travel conditions, emergency call-outs, equipment failure, or the need to complete a previous site safely before travelling to yours. We will use reasonable efforts to attend within the agreed timescale, but time shall not be treated as of the essence unless specifically agreed in writing. Delays alone do not entitle you to compensation unless the law requires otherwise.
We may use subcontractors or specialist operators where necessary to complete a job properly. If we do so, we remain responsible for the coordination of the contracted works, subject always to these terms. Any subcontractor engaged will be required to act in a manner consistent with the professional standards expected of a tree surgeon service. We may also amend the work sequence where necessary to achieve safe and efficient completion.
If you are a consumer, you may have rights under the Consumer Rights Act 2015 and related UK consumer protection law. Nothing in these terms is intended to reduce your statutory rights. Where you contract with us in the course of business, different legal protections may apply, and your rights may be limited to those expressly provided in these terms and in the quotation or invoice. Any implied term that cannot be excluded by law remains unaffected.
We may amend these Terms and Conditions from time to time. The version that applies will normally be the version in force when your booking is made, unless a later version is agreed in writing. Changes will not affect work already accepted and scheduled, except where required by law, safety, or operational necessity. It is your responsibility to review the terms applicable to your booking before confirming the work.
These terms, together with any written quotation or invoice, form the entire agreement between us and you in relation to the relevant tree surgery services. You may not assign, transfer, or subcontract your rights under the agreement without our written consent. If any clause is found to be invalid or unenforceable, the remaining clauses will continue in full force. A failure by us to enforce any right or remedy does not constitute a waiver of that right or remedy.
The agreement between the parties is governed by the laws of England and Wales. Any dispute or claim arising out of or in connection with these Terms and Conditions, the quotation, or the provision of tree surgery services shall be subject to the exclusive jurisdiction of the courts of England and Wales. Where possible, the parties should first attempt to resolve any disagreement promptly and in good faith before commencing formal proceedings.
